YOU MAY NOT ACCESS OR USE THIS SITE OR THE SERVICES IF YOU DO NOT AGREE TO ANY PART OF THESE TERMS.

THESE TERMS LIMIT THE REMEDIES AVAILABLE IN THE EVENT OF A DISPUTE AND REQUIRE THAT ALL DISPUTES BE RESOLVED THROUGH BINDING ARBITRATION. THIS MEANS YOU AGREE TO RESOLVE DISPUTES INDIVIDUALLY ACCORDING TO THE ARBITRATION PROVISIONS BELOW RATHER THAN IN A COURT OF LAW OR THROUGH A CLASS ACTION LAWSUIT.

You may delete your account at any time and for any reason by following the instructions on the Site. As further detailed below, we retain the right to suspend or terminate your account at any time and for any reason.

We reserve the right to review and investigate your use of the Site and to take any appropriate action against you that we determine is necessary for our sole discretion should you violate these Terms or otherwise create liability, loss, or damage for us, our Site visitors, or a third party. Such action may include, but is not limited to, restricting your account privileges or terminating your account, initiating proceedings to recover any losses, and reporting you to law enforcement authorities.

This includes the right to limit our visitors' use of Services and data storage. You agree that we are not liable for using or enforcing the rights stated in this paragraph. Although we may choose to provide customer support or website maintenance, you acknowledge and agree that we are under no obligation to do so.

Some parts of the Site may be restricted to certain visitors. If you have permission to access restricted parts of the Site, you agree not to share your access information and password with third parties. In addition, we may change the restricted parts of the Site from time to time. If you do not have access to restricted parts of the Site, you agree not to use another user's account to gain such access or otherwise attempt to gain improper access to the restricted parts of the Site.

We manage the collection, use, and security of your personal information according to our Privacy Policy, incorporated herein by reference. Using this Site, you consent to our collection and use of your personal information as outlined in the Privacy Policy.

We reserve the right to access and disclose the information you submit to the Site if required to do so by law or if we have a reasonable, good-faith belief that doing so is necessary for (i) responding to requests for customer service, (ii) addressing fraud, security, or technical issues, (iii) protecting the rights, property, and safety of Apteros Trading L.L.C., its users, and the public, (iv) responding to legal claims and processes, or (v) enforcing these Terms, including investigating potential violations.

  1. Apteros Trading L.L.C. Rights and Ownership

Unless otherwise stated, Apteros Trading L.L.C. and its permitted licensors own all intellectual property rights in the Site and its contents. These rights include but are not limited to ownership of all text, graphics, images, logos, copyrighted material, trademarks, patents, software, and other distinctive brand features displayed on the Site or Services, including the compilation of any of the preceding items. Except for the limited rights granted by these Terms, neither these Terms nor your use or access to the Site give you or any third party any intellectual property rights. We reserve all rights not explicitly granted by these Terms, which do not grant any implied licenses. All copyrights, trademarks, and other intellectual property notices on the Site or Services must be retained on all copies thereof. You may not publish, reverse engineer, modify, distribute, transmit, sell, create derivative or plagiaristic works of, or use or exploit for any commercial reason, whether in whole or in part, any of the content on the Site or Services without our express prior written consent or the consent of any third-party owners of the content. Site content is not for resale under any circumstances.

  1. Copyright Policy

We expect you to respect the intellectual property rights of others when using the Site and Services. Therefore, we will respond to any notices of copyright infringement that comply with applicable law and are properly submitted to us (pursuant to 17 U.S.C. 512(c)). To submit a notice of infringement of your copyrighted material, please provide us with the following information:

  2. Identification of the copyrighted work or works claimed to have been infringed;

We also reserve the right to take other appropriate action against infringers, such as terminating the User's account if the User is determined to be a repeat infringer. Note that pursuant to 17 U.S.C. 512(f), any material misrepresentation in a written notification that content is infringing or that allegedly infringing content was removed by mistake or misidentification automatically subjects the complaining party to liability for damages, including costs and attorney's fees incurred by the alleged infringer, by any copyright owner or copyright owner's authorized licensee, or by us, if injured by such misrepresentation.

  1. Sales Policies

All sales, including those for our bundled services of training programs and advanced group mentoring sessions, are final and non-refundable. By purchasing these services, users acknowledge that they are obtaining access to digital media and future-scheduled events that, once permitted by the user, are not returnable, exchangeable, or guaranteed.

Upon purchasing a bundle, access to any of its included materials, such as training programs, NADRO, intensive materials, or enrollment in our advanced group mentoring classes, signifies acceptance of this policy. Regardless of the level of interaction with these resources, the purchase is deemed to be complete and non-refundable.

  1. Membership Fees and Renewals

Membership fees, once paid, are non-refundable and must be terminated at least eight days before the next renewal date. Any cancellations made less than eight days before the renewal date will apply to the next billing cycle.

  • Advanced Group Mentoring Policy

Our advanced group mentoring program requires a substantial amount of preparation, coordination, and dedicated resources. As such, we enforce a strict no-refund policy for these sessions. By signing up for advanced group mentoring, users acknowledge their understanding of this policy.

Cancellation of a membership or bundle does not entitle users to a refund for any unused advanced group mentoring sessions. Refunds will not be issued for any circumstances including, but not limited to, scheduling conflicts, change of plans, dissatisfaction with the mentoring, or inability to attend.

  • Refund and Cancellation Policies

The content, membership services, training programs, and mentoring sessions we provide exist in a digital media format and future-scheduled events. Consequently, the fees, membership charges, and purchases are non-refundable.

In the event of a cancellation, the user must notify us at least eight days before the next renewal date. No refunds will be given for cancellations made less than eight days before the renewal date. Our policy maintains that no refund will be given under any circumstances once a user has purchased a bundle and gained access to any of the provided resources.

We reserve the right to change these terms and conditions at any time without prior notice. By continuing to use our services, you agree to abide by the revised terms and conditions.

  • Refund of Tryout Fees

  1. Purpose and Scope: This section outlines Apteros Trading's policy with respect to the refund of tryout fees paid by traders who successfully complete the tryout and are onboarded to the proprietary trading desk.

  2. Eligibility for Refund: A trader shall be eligible for a refund of the tryout fees only for the specific subscription period that directly led to the successful completion of the tryout and subsequent onboarding onto the proprietary trading desk.

    2.1 For clarity, if a trader has participated in multiple tryout sessions over different subscription periods, including instances where they canceled their tryout and then restarted, only the fees paid for the subscription period in which they successfully completed the tryout will be eligible for refund. Fees from previous or subsequent subscription periods, including those where the tryout was canceled and restarted, will not be eligible for refund.

    2.2 Only subscription fees are subject to refund under this policy. Other fees, such as resets or additional charges, are expressly excluded from this refund policy.

  3. Refund Procedure: The eligible tryout fees shall be refunded to the trader upon the first successful payout after their onboarding onto the proprietary trading desk. No subsequent payouts will include a refund of the tryout fees.

    3.1 The refund will be made using the original method of payment used by the trader unless otherwise agreed upon.

  4. Exceptions and Limitations: This refund policy applies exclusively to tryout fees. Any other fees, costs, or charges incurred by the trader during the tryout period are expressly excluded from this refund policy.

  5. Amendments: Apteros Trading reserves the right to amend, modify, or revoke this refund policy at any time without prior notice. However, any such amendments will not affect traders already onboarded onto the proprietary trading desk at the time of such amendment.

  • Acknowledgment of Inherent Risk in Trading

By purchasing our services, including but not limited to our bundled services, training programs, NADRO, intensive materials, or advanced group mentoring sessions, the user acknowledges that trading is inherently risky. A variety of factors, many of which are outside of our control and the user's control, can impact the outcomes of trades.

These factors can lead to losses, even significant ones. Despite this, our policy remains firm: all purchases are final and non-refundable. While we understand the impulse to request a refund in the face of such losses, we stand by our services and materials, which are designed to help users navigate the world of trading with more knowledge and expertise.

We strongly advise all users to only invest resources that they can afford to lose. Further, we encourage users to fully understand the terms and conditions of our services before making a purchase. In no circumstance will we provide a refund due to dissatisfaction with trading outcomes.

Our services aim to equip users with the knowledge, tools, and skills necessary to navigate the trading landscape, but they do not, and cannot, guarantee profitable outcomes. Users should enter into trading, and by extension, the purchase of our services, with a clear understanding of this. By purchasing our services, users are acknowledging their understanding and acceptance of these risks and of our no-refund policy.

THE EXISTENCE OF MORE THAN ONE CLAIM WILL NOT ENLARGE THIS LIMIT.
